( Both the expressions wherever
the context as permits shall mean and include their heirs, executors,
successors, assignees and other legal representatives and assignees.)
WITNESSESTH AS
UNDER:-
WHEREAS the Vendor abovenamed is
at the date of these presents of sole and undisputed owner, seized and
possessed of and is otherwise well and sufficiently entitled to a residential
Plot # ______________________________________________________ _________________
AND WHERAS the Vendor abovenamed
has filed an affidavit with the Sub-Registrar,
AND WHERAS the Vendor
abovenamed has agreed to transfer the lease hold rights in the said plot to the
aforesaid Vendee for a lump sum price of Rs._______/=.
NOW THIS INDENTURE OF SALE
WITNESSESTH AS UNDER: -
1. That in pursuance of Agreement
between Vendor and the Vendee and in consideration of a sum of
Rs.______/= (Rupees ____________________ only)
has been paid this day by the Vendee abovenamed to the Vendor abovenamed. The
receipt of which the said vendor hereby fully admits and acknowledge and doth
hereby release, acquit and discharge the said Vendee, the vendor abovenamed
hereby transfer to the Vendee abovenamed by way of
2. That the Vendor doth hereby grant. Sell, assign, convey and otherwise transfer the said Lease hold rights as well as ownership rights in the said plot to the aforesaid Vendee free from all sorts of claims, liens, demands, taxes, mortgages and burdens of whatsoever nature, TO HAVE AND HOLD the same for unto and to the use of the said Vendee subject to all terms and conditions if any upon which the Vendor hold the said plot.
3. That the Vendor doth hereby covenant with the
Vendee that the lease in respect of the said plot is in full force and is
subsisting and the Vendor have not committed any thing by which the same may be
impaired or has become or may become void or voidable and that ceases and
taxes, if any, due and payable by the Vendor have been paid upto the date or these
presents and if not so paid the vendor alone shall be liable therefore.
4. That the vendor doth hereby covenant and assures the Vendee
that he is the full owner of the plot hereby conveyed and transferred and none
else has any rights or interest in the said plot and he has good rights and
title and full authority to sell the said plot and that he has not prior to the
date of these presents done, made, committed, caused or knowing suffered to be
done, any such things or deeds whereby or by reason of which the right to
transfer the said plot has been or may be impaired or that the plot is charged,
encumbered or prejudicially affected in any way
5. That the Vendor doth hereby
covenant with the Vendee that they shall from time to time and at all times
whenever called upon by him i.e. by the Vendee do or cause to be done all
lawful and reasonable acts, things, deeds for better assuring and more
perfectly assigning the said plot unto the Vendee and he will keep the Vendee
indemnified and harmless against all actions, costs, damages, claims, losses
and detriments occasioned to and sustained by the Vendor due to any defect in
the title or any suit or demand preferred by one in respect of the said plot or
by reason of any act on the part of the Vendor affecting adversely the said
plot or any thereof.
6. That the Vendor has delivered
vacant, unquarreld and peaceful possession of the said plot to the Vendee
alongwith all its relevant documents and papers.
